Okay, I am pissed

    Here is my rant:

    My oldest daughter is returning home from work. She is driving the speed limit, OBEYING the law, when some other teenager pulls out in front of her. The other teenager had a stop sign while my daughter had the right of way on the main road.

    The two collide, my daughter trying her best to swerve to avoid the collision. The cop arrives. He collects the information from both, and later on we find he cites nobody. :confused:

    We wait for the insurance company to settle the claim with the other teenager's insurance company to get my daughter's car fixed. Yesterday we get a call from the other teenager's insurance company. Its the same company as we have. The person on the phone explains that they have decided amongst themselves that nobody was at fault so nobody gets to file a claim. :huh:

    I am sitting here trying to figure out how when someone pulls out of a side street and claims they didn't see the oncoming traffic the insurance company then decides it is nobody's fault. Now my daughter has no car, the other teenager gets away with failure to yield, and we now have to fork over money to get my daughter's car fixed or replaced, meanwhile still paying my insurance premiums of which I am trying to figure out why I pay in the first place since they won't insure anything. :disgust: :disgust: :disgust:

    SCAM SCAM SCAM, all insurance company get away with so much. Chris Rock called it incase shit happens fund. Well what if nothing happens over the 10 yrs i have it, do i get the money back?


    Manitou i would not sit still for this, i would keep complaining because the squeeky wheel gets the oil routine. If she was not at fault then they need to adjust the ruleing.

  3. Most states have an Insurance board for such complaints. Check it out, you have nothing lose.

  7. Mani, Ive seen this happen three times. The police are taking less and less of a role in accident reporting and leaving it up to the real criminals (the insurance companies). The insurance companies later call stating their client was not negligent. Although we all know they were. With little way to prove your innocence there is nothing you can do except go to small claims court which often costs more then the damages themselves not to mention your time and effort. The insurance companies know this and abuse the average user such as in your case. Lesson learned? When you get in an accident, INSIST on calling the Police. INSIST that the police officer states who is at fault or what traffic violation occured to cause the accident. GET IT ON PAPER. DONT LET THE police officer leave the scene without this. THEY WILL TRY because they dont want to be supponeod. Its sad but this happens all the time. Typical police response is we dont report accidents that we estimate damages at less then 1000 dollars, guess what, the damages are always more then that.
     
  8. i know the feeling, i was involve in 2 accidents. the first accident i was in a center turn lane and the driver of the other vehicle merges into me. the officer who responded didnt write it up as a report, so the kid didnt even get a citation. but thats not the best part, during the interview w/ the officer, thekid who hit said it was his fault. well he told his insurance company a different story and they blame me for the accident, saying it was my neglience that caused him to hit me! nice huh?
    Word to the wise, anyone whos involved in an accident, make sure that the insurance of the other party isnt progressive.


    EDIT: THIS POST WAS WRITTEN BY MY NURSE. I let her read the thread because she felt this only happened to her.

    Manitou, this might be a little late to ask, but did -anyone- witness this incident? One witness would would easily make the difference between paying 1000+ dollars to fix the car, vs having the insurance pay. As for the officer who wrote up the information, etc. he also should have checked. Are there any pictures? Christ, here in Canada the way how it works is that if you're on the 'through' road (as in no stop at any road intersection), all other side roads -MUST- yield to the primary road.

    I would definately goto the insurance board. Did your daughter have a stop? Details, I need them.

  11. Mani I have a pair of brown leather boots. I wouldn't mind burying them up a certain body orifice simply because I hate insurance agents and well, it won't stain my boots.;)

    It sounds like you have a good case on your hands. It seems to me that because both drivers were insured by the same company that they do not want to have a claim both against and for them. In other words, someone is just being lazy.

    Assuming you're still in the military, it wouldn't be a bad idea to contact your base lawyer to look into this. If you aren't in the military anymore, ask your neighbors/friends for a recommendation for a lawyer. Insurance companies hate going to court. Have the lawyer look into your case.

    sky, Ash and Jakob were checked and cleared that evening. Jakob was not real happy about the poking and prodding. :)

    As far as suing, I am not really sure that is in the best interest. Yeah, I could go to magistrate court, but do I have the time and extra money laying around? Not really. I am chalking this up as a learning experience. Next time (God forbid!) the cop does his job and we get it all on paper so there is no question.

  15. Ohhhhhhhh noooooooooooooooooooooooooooooo.

    This is just great right.

    So my wife pulls up to a rail road stop and there is a train coming. Lights flashing and all. So she stops. Nothing serious, not hitting the breaks hard, normal stop at a red light basically. Some dipshit rear ends her.

    My wife is all stressed out and panics a little, basically they just exchange information and go there separate ways. But we decide to go to the police station to file a report, blah blah blah garbage about not $1000 damage and we needed to have called them to the site (which I understand).

    Anywho, we pass all the information along to my insurance company and they are like, "Just go get the car fixed and we'll reimburse you the money." Anywho, we never could get a hold of the guy, think he gave us a bogus phone number but we did have his insurance policy number. In the end we claimed the accident but never got refunded our deductable like we were supposed to, our insurance company basically just gave up trying to get money from theres.

    Anyway, partly our fault for being naive. We'll do things differently next time.

    Bleh.

    Insurance sucks ass.

    So who is this insurance provider anyway?

    Unless you enjoyed getting assraped by your lovely insurance company I suggest you take them to court AND call your local newspaper. There's nothing a company hates more than bad media.

    Besides whatever happened to paying your $500-$1000 down and having your car fixed? Is it comsmetic damage or did you actually break something? It is kinda strange that the poliuce officer didn't fault either party... did she move the vehicle before the cop arrived? That can be one of the reason they don't find fault.

    ... your daughter has a kid?

  19. cival cort mani thats all not the inshrans comp but the one that hit her.driving a cab for a long time iv ben there lots and never lost.i dont realy know the macaniks of it sins my boss made me go but i gues its not very expensiv to file..it mite be difrent where you are at and it sounds like the milatery mite be involved on bowth ends so thats a mess.go speek to jag its free and maiby thay can help..good luck.
